1. 운영자, 적용 범위와 효력1. Provider, scope, and effective date
이 약관은 Swingby가 제공하는 BabyNote 앱과 관련 서비스의 이용 조건을 정합니다. 약관은 2026년 8월 15일부터 시행됩니다. 앱에서 약관과 개인정보처리방침을 확인한 뒤 BabyNote를 설치, 로그인 또는 계속 사용하면 이 약관에 동의한 것으로 봅니다. 동의하지 않으면 서비스를 이용하지 말고 필요한 경우 계정 삭제를 요청해주세요.These terms govern the BabyNote app and related services provided by Swingby and are effective August 15, 2026. By installing, signing in to, or continuing to use BabyNote after having access to these terms and the Privacy Policy, you agree to these terms. If you do not agree, do not use the service and request account deletion if needed.
2. 이용 자격과 보호자 권한2. Eligibility and caregiver authority
BabyNote 계정 사용자는 원칙적으로 만 14세 이상이어야 하며, 서비스 이용에 필요한 법적 능력을 갖추거나 법정대리인의 동의를 받아야 합니다. BabyNote는 만 14세 미만 아동이 직접 계정을 만드는 것을 대상으로 하지 않습니다. 사용자는 입력하거나 가족에게 공유하는 아기 정보와 사진에 대해 필요한 보호자 권한 또는 적법한 권한을 보유해야 하며, 다른 사람의 개인정보나 사진을 권한 없이 등록하거나 공유해서는 안 됩니다. 이 약관에 대한 동의는 혈액형·체온·투약·유축·키·몸무게 등 건강 관련 민감정보 처리에 대한 별도 동의를 대신하지 않습니다.BabyNote account users must generally be at least 14 and have legal capacity to use the service or authorization from a legal representative. BabyNote is not intended for children under 14 to create accounts directly. You must have the parental or other lawful authority needed for the baby information and photos you enter or share with family, and you must not upload or share another person's information or photos without authorization. Agreement to these Terms does not replace separate consent for processing health-related sensitive data such as blood type, temperature, medication, pumping, height, or weight.
3. 서비스 내용과 의료 고지3. Service and medical notice
BabyNote는 아기 프로필, 돌봄·성장 기록, 생활 패턴, 가족 일기와 공동양육자 공유 기능을 제공합니다. 표시되는 패턴과 통계는 사용자가 입력한 기록을 정리한 참고 정보이며 기록 누락, 입력 오류 또는 기기·네트워크 상태에 따라 실제 상황과 다를 수 있습니다.BabyNote provides baby profiles, care and growth records, life-pattern views, a family diary, and caregiver sharing. Patterns and statistics organize user-entered records for reference and may differ from actual circumstances because of missing records, input errors, or device and network conditions.
4. 계정 생성과 관리4. Account creation and management
사용자는 지원되는 Apple 또는 Google 계정으로 로그인합니다. 인증 계정, 연결된 기기와 접근 수단을 안전하게 관리하고 무단 사용이 의심되면 즉시 해당 인증 제공자와 BabyNote 고객지원에 알려야 합니다. 계정 또는 가족 초대 링크를 타인에게 판매하거나 공개해서는 안 됩니다.You sign in with a supported Apple or Google account. Keep the authentication account, connected devices, and access methods secure, and promptly notify the provider and BabyNote support if you suspect unauthorized use. Do not sell or publicly disclose an account or family invitation link.
계정 삭제는 앱의 프로필 설정에서 요청할 수 있습니다. 구체적인 삭제 범위, 공유 기록의 처리와 외부 인증 연결 해제 방법은 You may request account deletion from Profile settings in the app. See the 계정 삭제 안내Account Deletion guide를 따릅니다. for the deletion scope, treatment of shared records, and how to disconnect external authentication.
5. 가족 공유와 사용자 콘텐츠5. Family sharing and user content
가족 구성원을 초대하면 해당 사용자는 권한 범위에서 공유된 아기 프로필, 돌봄·성장 기록과 가족 일기를 보고 기록을 추가하거나 수정할 수 있습니다. 신뢰하는 사람만 초대하고 공유가 더 이상 필요하지 않으면 접근 권한을 정리해야 합니다.When you invite a caregiver, that person may view shared baby profiles, care and growth records, and family diary content and may add or edit records within their permissions. Invite only people you trust and remove access when sharing is no longer needed.
공유 가족 공간의 콘텐츠는 참여 가족이 함께 관리하는 기록입니다. 한 사용자가 계정을 삭제하더라도 다른 승인된 가족이 계속 사용하는 기록은 탈퇴 사용자의 직접 식별자를 제거한 뒤 가족 공간에 남을 수 있습니다. 단독 가족 공간은 계정 삭제 시 함께 제거됩니다. 사용자는 공유 전에 이 처리 방식을 고려해야 합니다.Content in a shared family space is jointly maintained by participating caregivers. If one user deletes an account, records still used by other authorized caregivers may remain in the family space after the departing user's direct identifiers are removed. A single-caregiver family space is removed with the account. Consider this treatment before sharing.
사용자는 자신이 등록한 콘텐츠에 대한 권리를 유지합니다. 사용자는 BabyNote가 서비스 제공, 동기화, 가족 공유, 백업과 삭제 요청 처리를 위해 필요한 범위에서만 해당 콘텐츠를 저장·복제·전송·표시할 수 있는 비독점적 권한을 부여합니다. 이 권한은 관련 콘텐츠가 적법하게 삭제되면 종료됩니다.You retain rights in content you submit. You grant BabyNote a non-exclusive permission to store, copy, transmit, and display that content only as needed to provide, sync, share, back up, and process deletion for the service. This permission ends when the relevant content is lawfully deleted.
6. 금지 행위6. Prohibited conduct
사용자는 다음 행위를 해서는 안 됩니다.You must not:
- 불법, 유해, 모욕적이거나 타인의 개인정보·초상권·저작권 등 권리를 침해하는 콘텐츠를 등록하는 행위Upload unlawful, harmful, abusive, or infringing content, including content that violates privacy, image, or copyright rights
- 권한 없이 다른 사용자의 계정, 가족 공간 또는 데이터에 접근하는 행위Access another user's account, family space, or data without authorization
- 보안 또는 접근 통제를 우회하거나 서비스·서버에 과도한 부하를 주는 행위Bypass security or access controls or place an unreasonable load on the service or servers
- 악성 코드, 자동화된 공격, 허위 초대 또는 부정한 목적으로 서비스를 사용하는 행위Use malware, automated attacks, deceptive invitations, or the service for fraudulent purposes
7. 이용 제한과 계약 종료7. Restriction and termination
약관이나 법령 위반, 다른 사용자 또는 아동의 안전·권리 침해, 보안 위협이 확인되면 필요한 범위에서 초대, 공유 또는 계정 이용을 제한할 수 있습니다. 긴급한 보안 조치가 아니라면 사유와 이의제기 방법을 가능한 범위에서 안내합니다.We may restrict invitations, sharing, or account access as reasonably necessary when there is a violation of these terms or law, harm to another user or child's safety or rights, or a security threat. Unless urgent security action is required, we will provide the reason and an appeal method where practicable.
사용자는 언제든 앱 사용을 중단하고 계정 삭제를 요청해 이용계약을 종료할 수 있습니다. 종료 후 개인정보와 공유 기록은 개인정보처리방침과 계정 삭제 안내에 따라 처리합니다.You may stop using the app and request account deletion at any time to terminate the service relationship. Personal information and shared records are then handled under the Privacy Policy and Account Deletion guide.
8. 서비스 변경과 가용성8. Service changes and availability
유지보수, 보안, 법령 준수 또는 서비스 개선을 위해 앱의 일부를 변경하거나 일시 중단할 수 있습니다. 서비스를 영구 종료하는 경우 합리적으로 가능한 범위에서 사전에 알리고 사용자가 필요한 기록을 정리할 기회를 제공합니다. 다만 긴급 보안 사고, 재난 또는 외부 인프라 장애처럼 사전 통지가 어려운 경우에는 사후에 알릴 수 있습니다.We may change or temporarily suspend parts of the app for maintenance, security, legal compliance, or service improvements. If the service is permanently discontinued, we will provide advance notice where reasonably practicable and an opportunity to organize needed records. Notice may follow an urgent security incident, disaster, or external infrastructure outage when advance notice is not practicable.
9. 책임, 보증과 사용자의 법적 권리9. Liability, warranties, and legal rights
BabyNote는 정확하고 안정적인 기록 도구를 제공하기 위해 합리적인 노력을 기울이지만, 사용자가 입력한 정보의 정확성, 의료적 판단에 대한 적합성 또는 중단 없는 서비스를 보증하지 않습니다. 사용자는 중요한 기록을 확인하고 의료적 결정에 앱만 의존해서는 안 됩니다.BabyNote uses reasonable efforts to provide an accurate and reliable record-keeping tool but does not warrant the accuracy of user-entered information, suitability for medical decisions, or uninterrupted service. Verify important records and do not rely solely on the app for medical decisions.
관련 법률이 허용하는 범위에서만 책임이 제한됩니다. 이 약관은 Swingby의 고의 또는 중대한 과실로 인한 책임, 생명·신체에 대한 책임 또는 소비자에게 적용되는 강행법규상 권리를 배제하거나 제한하지 않습니다.Liability is limited only to the extent permitted by applicable law. These terms do not exclude or limit liability for Swingby's intentional misconduct or gross negligence, liability for death or personal injury, or mandatory consumer rights.
10. 준거법과 분쟁 해결10. Governing law and disputes
사용자의 거주 지역에서 적용되는 강행법규를 우선하며, 그 범위 밖에서는 대한민국 법률을 적용합니다. 분쟁이 발생하면 먼저 고객지원을 통해 해결을 시도하고, 해결되지 않으면 관련 법령과 민사소송법에 따른 관할 법원에서 처리합니다.Mandatory laws of your place of residence take priority; otherwise, the laws of the Republic of Korea apply. We will first try to resolve disputes through support, and unresolved disputes will be handled by a court with jurisdiction under applicable law and Korean civil procedure rules.
11. 약관 변경과 문의11. Changes and contact
약관을 변경하면 최종 수정일을 갱신하고 BabyNote 웹페이지 또는 앱에서 알립니다. 일반 변경은 원칙적으로 7일 전에, 사용자에게 불리한 중요한 변경은 원칙적으로 30일 전에 안내합니다. 법령·보안상 즉시 적용이 필요한 경우에는 적용 후 지체 없이 알릴 수 있습니다. 변경에 동의하지 않으면 시행일 전에 이용을 중단하고 계정 삭제를 요청할 수 있습니다.When these terms change, we update the date and announce the change on the BabyNote website or in the app. We normally give 7 days' notice for general changes and 30 days' notice for material changes adverse to users. Changes required immediately by law or security needs may be announced without undue delay after taking effect. If you do not agree, you may stop using the service and request account deletion before the effective date.
